Sublease of Nuclear Imaging Camera Violated Stark Law, Says Judge

Last week, U.S. District Judge Maurice B. Cohill, Jr. granted partial summary judgment to four doctors who blew the whistle on illegal referral arrangements between the hospital where they worked and a competing group of physicians. According to the opinion, the whistleblowers established as a matter of law that Bradford Regional Medical Center — a Pennsylvania non-profit hospital — violated Stark by improperly paying for patient referrals through a sublease of a nuclear imaging cameras. The opinion also indicated that the qui tam relators have compelling evidence of possible Anti-kickback violations. Read the entire opinion below:
