Circle C Construction Underpays Workers, Violates Davis-Bacon Act at Fort Campbell

March 24, 2010

According to findings by federal district judge William J. Haynes, Circle C Construction, LLC paid electricians at Fort Campbell Army base as low as $12 per hour while representing to the DoD that they paid a minimum of $19.19 plus fringe benefits of $3.94 per hour, as required by the Davis-Bacon Act. Judge Haynes ordered the company to pay treble damages in the amount of $1,661,423.13 for the False Claims Act violations.

“The United States Attorney’s Office will vigorously pursue allegations that government contractors have not dealt fairly with the United States and its agencies,” said U.S. Attorney Ed Yarbrough. “Moreover, businesses that contract with the government to pay prevailing wages to employees and contractors on government projects will be held to the letter of their agreement in order to protect local wage standards for the benefit of local workers.”

I’m working on a federally funded Davis Bacon project as a Journeyman Pipefitter and was paid hours as a laborer, crane operator, and as an “assembler” all while installing pipe supports. I consider hanging pipe supports to be part of the work of a Journeyman Pipefitter. I am not a certified crane operator, my foreman said he did not segregate my hours that was done by someone offsite. There are several hands who were done the same way. I consider this to be abuse of the Davis Bacon acts spirit of protecting the worker. Is my complaint legitimate ?
